1. Acceptance of Terms
By accessing or using Lumiora (the “Service”), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the Service. Your continued use of Lumiora following any changes to these terms constitutes acceptance of those changes.
2. Service Description
Lumiora provides cloud-based photo booth software designed for event organizers. The Service includes photo capture, digital galleries, sharing tools, and optional AI-enhanced features. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
3. Account Registration
To use Lumiora, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must be at least 18 years of age to register and use the Service.
4. Subscription & Payments
Paid plans are billed on a recurring basis via Stripe and will automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Refunds are granted at Lumiora's sole discretion and are not guaranteed except where required by applicable law.
5. Acceptable Use
You agree not to upload, share, or process any content that is illegal, harmful, defamatory, or infringes on third-party rights. You may not attempt to reverse engineer, decompile, or otherwise derive the source code of the Service. We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
6. Intellectual Property
You retain full ownership and intellectual property rights to all photos and media you upload to the Service. Lumiora retains all rights to the platform, software, and associated intellectual property. By uploading content, you grant Lumiora a limited, non-exclusive, royalty-free license to host, store, and display your content solely for the purpose of providing the Service to you.
7. Data Processing & Privacy
All data is processed and stored within the European Union in accordance with the General Data Protection Regulation (GDPR). Our full data handling practices are described in our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the collection and processing of your data as described therein.
8. AI Features
Lumiora offers optional AI-enhanced features powered by Google Gemini AI. When you enable AI features, your photos and related data may be processed by Google's AI infrastructure in accordance with Google's terms and privacy policies. By enabling AI features, you explicitly consent to this processing. AI features are entirely optional and the core Service functions without them.
9. Limitation of Liability
The Service is provided “as is” and “as available” without any warranties of any kind, express or implied. Lumiora does not warrant that the Service will be uninterrupted, error-free, or completely secure. To the maximum extent permitted by law, our total liability to you for any claim arising from your use of the Service is limited to the amount you paid to Lumiora in the twelve months preceding the claim.
10. Termination
Either party may terminate the agreement at any time. You may close your account through your account settings; we may terminate or suspend your account for violation of these Terms. Upon termination, your data will be retained for up to 30 days to allow for recovery, after which it will be permanently deleted.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the European Union and applicable member state law. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts within the European Union.
